Thats right... you can believe your eyes, its not a prank. The venue is booked, the deposit is down. Its happening. Preparations are already underway for Shpongle's first full LIVE performance in the UK which will be showcasing not only the old material played by a 7 piece band but also some of the new material that will be making up Shpongle's 4th Album. Its been talked about for 10 years, but now its happening. Its in the Roundhouse in London. It will be a concert type affair, not an all night party. We will soon begin selling tickets to this event. A panel of judges at the Copyright Royalty Board has denied a request from the NPR and a number of other webcasters to reconsider a March ruling that would force Internet radio services to pay crippling royalties. The panel's ruling reaffirmed the original CRB decision in every respect, with the exception of how the royalties will be calculated. Instead of charging a royalty for each time a song is heard by a listener online, Internet broadcasters will be able pay royalties based on average listening hours through the end of 2008.

The ruling is a huge blow to online broadcasters, and the new royalty structure could knock a large number of them off the 'Net entirely. Under the previous setup, radio stations would have to pay an annual fee plus 12 percent of their profits to the music industry's royalty collection organization, SoundExchange. It was a good setup for the webcasters, most of whom are either nonprofits or very small organizations.

National Public Radio spearheaded the appeal, arguing that the CRB's decision was an "abuse of discretion" and saying that the judges did not consider the ramifications of a new royalty structure. Under the new royalty schedule, NPR will see its costs skyrocket.

The judges were unmoved by the webcasters' arguments. "None of the moving parties have made a sufficient showing of new evidence or clear error or manifest injustice that would warrant rehearing," wrote the CRB in its decision. "To the contrary... most of the parties' arguments in support of a rehearing or reconsideration merely restate arguments that were made or evidence that was presented during the proceeding."

SoundExchange is jubilant over the ruling. Executive Director John Simson called the CRB's ruling a victory for performing artists and record labels. "Our artists and labels look forward to working with the Internet radio industry—large and small, commercial and noncommercial—so that together we can ensure it succeeds as a place where great music is available to music lovers of all genres," said Simson in a statement.

Noble words, but after today's ruling—which will take effect on May 15 unless the US Court of Appeals for the District of Columbia Circuit agrees to hear an appeal—there probably won't be much of an Internet radio industry left for SoundExchange to work with.

In a case of unfortunate timing, the SaveNetRadio coalition today launched a campaign to save Internet radio. Given the CRB's decision, it may be too little, too late.

This is a Live on the fly set that I started on Diwali 2006. Due to recording problems I was unable to get the whole thing on disc that night. I redid this on Halloween as a Dark to Lightness (sorta) hard edged trippin’ mix.

This mix is a slammin’, floor bashin’, system blastin’ set that will take you from your darkest nightmares to your happiest twisted dreams, and then back to the worst nightmares you’ll ever imagine.

The last track is a special G. W. BUllSH*t remix about our Free Speech and Freedoms being threatened.

Assembling shamanic soundforms

Dear Shpongle Tribe:

I just joined this tribe and I wanted to tell you a bit about myself and a vision that's currently forming within me.

My name is Shalom and I'm a photographer - I'm also a passionate lover of the kind of conscious, expansive electronica that Shpongle creates as well as the other masters of shamanic soundforms: Shulman, Entheogenic, Shakatura, Bluetech, and my friend David Battenfield.

I have a vision of creating a music mix that awakens the listener into a felt experience of the One. I've put together a few mixes of expansion-catalyzing music, which I've shared with friends at lucid music appreciation gatherings (to which each of us brings a mix). [There are six or seven of us – we gather, become illuminated, and share our mixes with each other, which we listen to in total silence. We've done this a number of times, and it's been a glorious experience every time.] This time, I'm thinking about taking my music appreciation mix to the next level by contacting the artists who I’d like to include in the mix, and asking for their permission to assemble their songs into a compilation that I would seek to have distributed by a label.

I want to do this in a way that truly benefits everyone involved in the process - musicians, producer, label, and listeners. I have some close friends who are established musicians with CDs on the market, so I'm taking my cues from them about how to develop this project.

One thing is clear: the intention of this mix is to combine onto a single CD sounds that awaken the heart and mind to an immediate felt experience of the One. Today’s urban-techno-shamanistic revival (expressed through the heart of the Burning Man culture, through the new Entheogenesis film, through our conscious dance and movement culture, through awakened spiritual practice) is a vital driver of what I feel is a global awakening that's happening now. I see groups such as Entheogenic, Shulman, Shpongle, Bluetech, and company to be supplying fuel for this evolution. I believe that the universe is ripe for this evolution, and for the active participation of those who are deeply committed to it. One of the ways that I, personally, see to participate in this is to assemble shamanic soundforms across an array of artists into a single CD that functions as a carrier wave for this evolving consciousness.

A big ambition, I know.

I believe that it's not only possible, but vital and necessary. The world thirsts for light, for union, for celebration of the One. This is my mission.

And so, I send this message out to the Shpongle tribe, trusting that in the rampant perfection of things, it will reach exactly the hearts and minds it needs to reach.

I am just getting back to spinning after a long term break. This is my latest attempt to try to be a DJ (lol).

This mix was done with one very old T1500 and two virtual DJ programs. I had no mixer or board support except for the cross fader on my old P3 computer.

This mix was performed live on the fly and I think it sounds pretty good.

Looking for Shpongle fans for photo models and photography

I am submitting photos of my car to Twisted for a photo layout in their newsletter. I already have approval for these submissions from Twisted, as my license plate reads "SHPONGL" and for a while now they have been awaiting my approved/formal pictures (what can i say, life stuff, delays...sigh.)

I still have some work on the car that I need done but I am trying to line up two female models who are Shpongle-minded and are interested in modeling in some of the photos with my car, and a photographer should any be interested.

I am more interested in Shpongle fans than I am hot bodies; if you are not a Shpongle fan, please do not apply -- that includes the photographer! :)

There are thousands of good people who could potentially lose their lives very soon.

Since the release of the information on the Sujiatun concentration camp in China, which is reported to do live organ harvesting on Falun Gong practicioners. More people have been stepping forward to reveal information. Recently, a veteran military doctor in the region of Shenyang said that the Sujiatun Concentration camp is just one of 36 such camps. Another camp in Jilin Province referred to as 672-S is said to hold over 120,000 people.

According to the Integrated Committee's announcement, transplant hospitals in China are now telling patients to "come in quickly" to get transplants. Patients are told that matching organs can be found at this time in as short as one or two days. The hospitals are also reported to say that, "it will be difficult after this batch of organs is used up."

We fear that there is going to be a mass execution to “hide the evidence” and get rid of witnesses. PLEASE HELP us, Falun Gong practitioners around the world are requesting an international investigation while there is still time.

My question is if anyone has smoked dmt to the new albumn? I know simon has said in interviews that he has only smoked dmt three times in his life. I think he captures alot of the experience in his music. Quality over quantity. Anyone else have thoughts on this?

From my friend who manages Tower Records in Pasadena:

So it looks as though most of the Tower stores will get the Shpongle CD. The bigger stores in the bigger markets are more likely to have larger quantities. My store will most likely have the highest quantity in the area, with Sunset, Long Beach, Sherman Oaks and Vegas getting decent numbers.

Our Imports Coordinator wants me to let him know what I think of the album after I hear it. If it's as good as "Tales" he'll add it to our Import Spotlight Program which will get it endcap placement and sale pricing in the Top 20 stores.

They also have very few copies left of "Tales of the Inexpressible", which you can buy from the Tower website. Otherwise, it's out of print, I'm afraid.

I have no clue where one could find the first album.

And yes, it is as good as "Tales" for those of you who want to know.
